Terms of Use

The Wishing Well is a personal reflection and contemplative practice application. It uses AI-assisted writing to help you articulate desires and generate first-person narrative scenes designed for meditation, journaling, and personal development.

Nothing in the app — including AI-generated content, guided prompts, or session materials — constitutes medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, thoughts of self-harm, or a medical emergency, please contact a licensed professional or call emergency services immediately.

The app does not create any professional-client relationship between you and us.

The app does not guarantee any specific life outcomes, manifestations, results, or changes. Personal development tools work differently for different people. Your results depend entirely on your own effort, circumstances, and choices. We make no representations about what you will experience.

You must be at least 13 years old to use the app. If you are under 18, you must have your parent or guardian’s consent. By using the app, you represent that you meet these requirements.

You create an account using your email address and a one-time code. You are responsible for:

• Keeping your email account secure
• All activity that occurs under your account
• Notifying us immediately at hello@thewishingwell.app if you suspect unauthorized access

We may suspend or terminate accounts that violate these Terms.

Session fees: Individual sessions are available for purchase at the price displayed at time of purchase. Current price: $29.99 per session.

No refunds on completed sessions: Because each session involves real-time AI generation (compute costs are incurred immediately), completed sessions are generally non-refundable. If you experience a technical failure that prevented you from receiving your session output, contact hello@thewishingwell.app within 7 days.

Billing:Payments are processed by Stripe. By providing payment information, you agree to Stripe’s terms and authorize us to charge the stated amount.

Price changes: We may change prices with 30 days notice. Continued use after notice constitutes acceptance.

The app uses artificial intelligence (Anthropic’s Claude models) to generate personalized narrative content. By using the app, you understand and agree:

• AI-generated content may contain errors, inaccuracies, or unexpected outputs
• Content is generated based on what you provide — input quality affects output quality
• AI-generated scenes are fictional narrative explorations, not predictions, guarantees, or literal descriptions of any future or past event
• We do not review individual AI outputs before you see them, though we maintain content safety guidelines in our system design

Your inputs: You retain any rights you have in the desire text and feedback you submit. By submitting, you grant us a limited license to process it solely to provide the service.

Our outputs: AI-generated scenes are licensed for your personal, non-commercial use. You may not reproduce, sell, or distribute session outputs.

You agree not to:

• Use the app for any unlawful purpose
• Submit content that is abusive, harassing, threatening, or discriminatory
• Attempt to reverse-engineer, decompile, or extract our prompt architecture or system logic
• Use automated tools to scrape, bulk-generate, or resell sessions
• Impersonate any person or entity
• Attempt to circumvent payment or access controls
• Submit false or misleading information

We may suspend or terminate your account for violations without notice.

The app, including its software, design, text, prompts, visual elements, and AI orchestration logic, is owned by Iseoluwa Ink and is protected by copyright, trademark, trade secret, and other applicable laws.

“The Wishing Well” name and logo are trademarks of Iseoluwa Ink. You may not use them without written permission.

Nothing in these Terms transfers any IP rights to you beyond the limited license to use the app as intended.

Your use of the app is also governed by our Privacy Policy. By using the app, you consent to the data practices described there.

Some jurisdictions do not allow these limitations — in those jurisdictions, liability is limited to the extent permitted by law.

You agree to defend, indemnify, and hold harmless Iseoluwa Inkand its team from any claims, liabilities, damages, and expenses (including attorneys’ fees) arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.

Informal resolution: Before filing any claim, you agree to contact us at hello@thewishingwell.app and attempt to resolve the dispute informally for 30 days.

Governing law: These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

We may suspend or terminate your access to the app at any time, with or without cause, with or without notice. You may delete your account at any time from app settings or by contacting hello@thewishingwell.app.

Upon termination, your license to use the app ends. These Terms survive termination to the extent necessary to enforce rights and obligations that arose before termination.

We respect intellectual property rights. If you believe content on the app infringes your copyright, send a written DMCA notice to our designated agent:

Your notice must include: identification of the copyrighted work and the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and you are authorized to act.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice with at least 14 days advance notice. Continued use after the effective date constitutes acceptance.
